These Terms and Conditions (“Terms”) govern your use of our website and the supply of services and goods by RS AIR CON LTD (“we”, “us”, “our”). By using our website, requesting a quote, or placing an order, you agree to these Terms. If you do not agree, please do not use our services.
Where you are a consumer, nothing in these Terms affects your statutory rights under UK law.
1. About us
We provide air conditioning and related services (such as installation, maintenance, repair, and surveys) as described on our website or in your written quotation or order confirmation. Specific scope, price, and timing will be as agreed in writing for each job unless we state otherwise.
2. Quotations and orders
Quotations are invitations to contract unless we state they are binding. A contract is formed when we confirm your order in writing (including by email) or when we start work with your agreement. We may refuse an order where we cannot fulfil it or where information provided is incomplete or inaccurate.
Descriptions, drawings, and specifications are approximate unless expressly stated as fixed. Site surveys may be required before a final price is confirmed.
3. Price and payment
Prices are as quoted or as shown at checkout (where applicable), plus VAT at the applicable rate unless stated as inclusive. We may require a deposit or staged payments. Late payment may incur interest and recovery costs as permitted by law. Title to goods (where supplied) may remain with us until payment in full.
4. Access, site conditions, and cooperation
You agree to provide safe access, utilities where needed, and accurate information about the site. Delays or extra work caused by concealed conditions, access restrictions, or incomplete information may result in additional charges and revised timings, which we will discuss with you where reasonably practicable.
5. Timing and delays
Dates are estimates unless we agree a fixed date in writing. We are not liable for delays caused by events outside our reasonable control (including weather, supplier delays, or your failure to provide access). We will aim to notify you of material delays.
6. Warranty and defects
Any warranty for labour or goods will be as stated in your order documentation or manufacturer terms. You must report defects within a reasonable time of discovery. We may inspect and, where justified, repair, replace, or refund in line with applicable law and any written warranty. Exclusions may apply to misuse, unauthorised alterations, or fair wear and tear.
7. Limitation of liability
To the fullest extent permitted by law, we exclude liability for indirect or consequential loss, loss of profit, or loss of business. Our total liability arising from or in connection with a contract (except liability that cannot be limited by law, including death or personal injury caused by negligence, or fraud) shall not exceed the amount you paid us for the relevant services or goods in the twelve months before the claim, or £5,000, whichever is higher.
Nothing in these Terms limits any liability that cannot legally be limited.
8. Your responsibilities
You are responsible for obtaining any consents, landlord approvals, or permissions required for the work. You must ensure our staff and contractors can work safely and in compliance with site rules.
9. Cancellation and refunds
Cancellation, cooling-off, and refund rules are set out in our Refund and Cancellation Policy, which forms part of these Terms where applicable.
10. Intellectual property
Content on our website (text, images, logos) is owned by us or our licensors. You may not copy or reuse it without permission except as allowed by law.
11. Website use
You agree not to misuse our website (for example by introducing malware, scraping in a way that harms our systems, or attempting unauthorised access). We may suspend access where necessary for security or maintenance.
12. Complaints
If you have a concern, please contact us and we will try to resolve it promptly.
13. Governing law
These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, subject to mandatory protections for consumers in their home jurisdiction where applicable.
14. Changes
We may update these Terms from time to time. The version on this page applies to new orders and bookings after the “Last updated” date unless we notify you otherwise.
